Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of DashOwl — the business command-centre software available at dashowl.co and app.dashowl.co (the "Service").

1. Acceptance of these Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business, you confirm you are authorised to bind that business to these Terms.

2. The Service

DashOwl brings a business's data — such as store orders, products, customers, advertising performance, payments, shipping and messaging — into one dashboard, and provides analytics, reports, AI-generated insights and messaging tools on top of that data. Features may be added, changed or removed as the product evolves.

3. Your account

• You must provide accurate information when signing up and keep your login credentials confidential.
• You are responsible for all activity under your account. Tell us immediately if you suspect unauthorised access.
• One person or business may not maintain accounts for abusive, fraudulent or unlawful purposes.

4. Connected platforms

• The Service works by connecting third-party platforms you already use (for example your online store, ad accounts, analytics, payment gateway or WhatsApp Business). You choose what to connect.
• By connecting a platform, you authorise DashOwl to access and fetch that platform's data on your behalf, strictly to provide the Service to you.
• You may disconnect any platform at any time from the Integrations section of your dashboard.
• Your use of each connected platform remains governed by that platform's own terms (for example the Meta Platform Terms, Shopify's terms, or Google's terms). We are not responsible for third-party platforms' availability, accuracy or policy decisions.

5. Fees, billing and taxes

• Paid plans are billed in Indian Rupees (INR) through our payment partner Razorpay, on a subscription basis (monthly or annual, as chosen at checkout).
• Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. See our Refund & Cancellation Policy.
• Usage-based credits (for example AI or messaging credits), where offered, are consumed as used and are non-refundable once consumed.
• Prices are exclusive of applicable taxes (such as GST) unless stated otherwise. We may revise pricing with reasonable advance notice; changes apply from your next billing cycle.

6. Acceptable use

You agree not to:

• use the Service to send spam or unsolicited messages, or to violate messaging platform policies (including WhatsApp Business policies);
• upload or transmit unlawful content, malware, or content that infringes others' rights;
• attempt to probe, reverse-engineer, scrape at scale, disrupt or gain unauthorised access to the Service or its infrastructure;
• resell or sublicense the Service without our written consent.

7. Your data and our IP

• Your data stays yours. Business data you connect or upload remains your property. You grant us a limited licence to process it solely to provide and improve the Service for you.
• The Service itself — software, design, branding, and everything that isn't your data — is owned by EARTHASANA and protected by applicable intellectual-property laws.

8. AI-generated content

The Service uses artificial intelligence to generate insights, summaries and suggestions. AI output is provided for informational purposes only, can be inaccurate or incomplete, and is not financial, legal, tax or professional advice. Business decisions you take based on the Service are your own responsibility.

9. Availability and disclaimers

We work hard to keep the Service available and accurate, but it is provided "as is" and "as available", without warranties of any kind, express or implied. Data shown in the dashboard depends on third-party platforms and may lag or differ from those platforms' own reporting.

10. Limitation of liability

To the maximum extent permitted by law, EARTHASANA's total aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue or data.

11. Suspension and termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate access for breach of these Terms, non-payment, legal requirement, or misuse that risks the Service or other customers — with notice where reasonably possible.
• On termination, your right to use the Service ends; data-deletion is handled per our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after the effective date of an update constitutes acceptance.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Courts in Chhattisgarh, India shall have exclusive jurisdiction, subject to applicable law.
